Insurance Producer Terms
These Insurance Producer Terms are part of the Wynlo Terms of Service and apply because Wynlo is built for a regulated profession. They allocate the insurance-specific responsibilities that software cannot take off a licensed professional’s shoulders — and they define exactly what Wynlo’s insurance-related features are, and are not.
1. Licensing
- You are responsible for holding, and keeping in force, every insurance producer license your activities require — including licensure in the states where the consumers you solicit are located, where the law requires it.
- Where a carrier appointment is required for your activities, maintaining it is your responsibility.
- Wynlo does not verify licenses and does not authorize anyone to transact insurance. Using Wynlo is not a substitute for any license, appointment, or registration.
2. Your representations to consumers
What is said to a consumer in your campaigns is your responsibility, whether said live, through content you configure, or through automation you direct. You must comply with the insurance advertising and unfair-trade-practices laws that govern sales communications. In particular, you must not:
- represent or imply that a consumer is approved, is eligible, or will be issued coverage, or that coverage is in force, before the carrier has acted;
- guarantee a premium, rate class, or underwriting outcome;
- imply affiliation with, or endorsement by, a carrier, lender, employer, or government agency that does not exist;
- describe voluntary products or information as mandatory;
- make claims about a policy’s benefits, terms, or conditions that are untrue or misleading in fact or by implication.
Scripts and content you author or customize are yours. You are responsible for their accuracy and lawfulness before using them with consumers.
3. AI features are decision support
Wynlo’s AI features — including AI-assisted calling, in-call suggestions, and post-call coaching — are workflow and decision-support technology for licensed professionals. A licensed producer retains responsibility for every insurance recommendation and every representation made to a consumer. AI output can be imperfect; you must exercise your own professional judgment before relying on it or repeating it to a consumer.
4. Carrier Qualification
The Carrier Qualification feature provides reference guidance for licensed professionals: it matches details captured about a lead against carrier underwriting criteria from available carrier materials and suggests which carrier may be worth evaluating first, with the underlying guideline wording cited. Its limits are part of these terms:
- It is decision support only. It is not an underwriting determination, an approval, an offer of coverage, a guarantee of eligibility, or a quote.
- The carrier retains final and exclusive underwriting authority. Only the insurer decides whether to issue coverage, on what terms, and at what rates.
- Carrier guidelines change without notice, and the materials reflected in the feature may not be the carrier’s newest version. You must verify current carrier guidance before submitting business or making representations to a consumer.
- Wynlo makes no warranty of eligibility, approval, premium, rate class, or issuance, and no warranty that carrier reference materials are current, complete, or error-free.
- Output is provided to you, the professional — it is not designed or intended to be presented to consumers as a determination about their coverage.
5. What Wynlo is not
Wynlo is software. Wynlo is not an insurance carrier, agency, brokerage, IMO, or producer; it does not sell, solicit, or negotiate insurance; it does not underwrite, issue, or service policies; and it receives no insurance commissions. Policy and coverage decisions are made by insurers and by the licensed professionals who serve their clients.
6. Records
Insurance regulators expect producers and agencies to maintain records of their sales activities, often for multiple years. You are responsible for meeting the record-keeping obligations that apply to your business; Wynlo’s records are a convenience, not a substitute for your own compliance program.
